Terms and Conditions and Privacy Policies
A- GENERAL
This document outlines the Terms and Conditions, Privacy Policy, and Cookie Policy, hereinafter referred to as “THE AGREEMENT,” applicable to the use of the program pshmusic.yfse.org, a platform designed to receive donations for the PSH Music program, hereinafter referred to as “THE PROGRAM.” The funds raised are intended for the creation of “Músicos Por Los Bosques,” an online music academy aimed at empowering people to connect with music and environmental conservation. THE AGREEMENT must be read, understood, accepted, and adhered to by users of THE PROGRAM, hereinafter referred to individually as “USER” and collectively as “USERS,” and is always applicable in its current version at the time of use.
B- THE AGREEMENT
THE AGREEMENT may be freely updated by PSH Music at its discretion, taking immediate effect upon publication on THE PROGRAM’s website. PSH Music is not obligated to announce these updates through any additional means.
PSH Music does not require USERS to perform any activity within THE PROGRAM. USERS who do not accept THE AGREEMENT may engage with THE PROGRAM at their own risk. It is assumed that USERS accept the terms set forth in THE AGREEMENT; otherwise, PSH Music is not responsible for the use or consequences arising from it.
C- INTELLECTUAL AND INDUSTRIAL PROPERTY
THE PROGRAM allows USERS to access, understand, and use PSH Music initiatives exclusively for personal and educational purposes, without commercial intent. USERS may not copy, publish, market, reproduce, adapt, or modify THE PROGRAM, nor use or commercially exploit its content without written authorization from PSH Music.
D- PRELIMINARY CONSIDERATIONS
PSH Music has established procedures to ensure that educational and technical information is clear and accurate. In case of an error beyond our control, it will be corrected immediately.
E- ELECTRONIC DONATION
A donation is the act of giving funds or material goods out of solidarity between two natural or legal persons. For the purposes of this document, the term DONATION will be interpreted in accordance with this definition.
F- DONATIONS TO THE "PSH MUSIC" PROGRAM
Donations to the PSH Music program can only be made in U.S. dollars. There are two types of donations: PERSONAL and CORPORATE. Individuals or legal entities may choose from the suggested amounts to make DONATIONS or donate an amount of their choice under the OTHER category. Depending on the donated amount, donors may receive digital incentives explicitly provided by PSH Music as a token of appreciation.
G- DIGITAL INCENTIVES
As a token of appreciation, donors may receive digital incentives based on the donated amount, which may include, but are not limited to:
- Digital participation certificates.
- Digital recognition badges.
- Exclusive access to eBooks.
- Other digital materials related to the PSH Music program.
PSH Music reserves the right to modify the incentives offered depending on availability and ongoing campaigns. These incentives are personal, non-transferable, and have no commercial value. Incentives will be sent to the email address provided by the USER during the donation process.
H- CANCELLATION AND REFUND POLICY
Due to the nature of donations, they are final and non-refundable. PSH Music does not accept refund requests once the donation process is completed, as the funds are immediately allocated to THE PROGRAM and its activities. However, if an error occurs during the donation process, the USER may contact PSH Music through the email provided on THE PROGRAM’s website for assistance.
I- DATA SECURITY AND PRIVACY
PSH Music is committed to protecting the privacy of its USERS’ personal data. All information collected during the donation process is used exclusively for the purposes described in THE AGREEMENT and in accordance with our Privacy Policy.
PSH Music does not store credit or debit card information, as transactions are conducted directly through financial institutions. For additional security, USERS should review the privacy policies of the entities PSH Music collaborates with.
J- COOKIE POLICY
THE PROGRAM’s website uses cookies to enhance the user experience and provide personalized service. The use of cookies is detailed in the Cookie Policy, which must be accepted when browsing and using the services offered by PSH Music.
K- LIMITATION OF LIABILITY
PSH Music is not responsible for any damage or loss resulting from the improper use of THE PROGRAM’s website or inaccurate information provided by the USER. Additionally, PSH Music assumes no responsibility for technical issues, connection failures, or any other problems beyond its control that prevent a donation from being completed or digital incentives from being delivered.
